This contract states the terms and conditions by which Highland House of Fraser Ltd (‘the Supplier’) agrees to provide you (‘the Hirer’) with Highland Dress hire wear.
All hire wear remains the supplier’s property at all times and is provided for the duration of the hire period stated on the reservation form. It is the hirer’s responsibility to take reasonable care of the hire wear whilst in his/her possession.
a) Each in-store reservation is subject to a maximum of 15 minutes and includes if required, a fitting service for kilt, jacket and shoes only which is provided free of charge.
b) Photographic identification must be presented such as a driving licence or passport, bearing current address.
c) A 50% deposit is payable at the time of the hire reservation. The balance due must be paid no later than one week before the collection date stated on the reservation form. If no final payment has been made in sufficient time then the hirer authorises the supplier to charge the balance due to the hirer’s credit or debit card supplied at the time of reservation.
d) Any changes to measurements must be notified at the earliest opportunity as the supplier cannot guarantee availability of alternative hire wear. This is particularly important for children’s hire wear and where hire reservations are made several months in advance.
e) Any changes to hire reservations within one week of the hire collection date will be subject to a fee of £10.00.
f) The supplier will provide all hire wear in good condition and free from defects and staining. Dry cleaning may result in slight shading differences in garments and therefore any group bookings should take this into consideration.
g) The supplier takes great care to ensure that hire wear is prepared and packed correctly however, the hirer is required to double check the contents upon in-store collection or delivery via carrier and report any missing or damaged items to the supplier within 24 hours, failure to do so may result in the hirer being charged the full current retail replacement value to the hirer’s credit or debit card.
h) Following in-store collection or delivery via carrier, if any hire wear does not fit satisfactorily, the supplier will (if available) replace free of charge if notified within 24 hours. Delivery costs of any such replacement hire wear will be charged to the hirer’s credit or debit card.
i) Late return of hire wear will be charged to the hirer’s credit or debit card at the rate of £15.00 per day for a maximum of 7 days. After 7 days of non-return it will be assumed that the hirer will not be returning the hire wear and the hirer’s credit or debit card will be charged for the full current retail replacement value.
j) The supplier shall not be liable for any damages or injury caused by misuse of any hired item whilst in the possession the hirer.
k) The hirer agrees to treat all hire wear with reasonable care and is responsible for the safe keeping and safe return.
l) The hirer will not alter or modify hire wear whilst in his/her care.
2. Delivery via carrier
a) Delivery of hire wear will be despatched 48 hours prior to the hirer’s function date and will be collected the following day (except Sat/Sun). Delivery and collection will be made between 9.00a.m. and 5.00p.m. by the suppliers contracted third party carrier.
b) The supplier shall not be liable for any failure to deliver by a third party carrier.
c) The hirer’s credit or debit card will be charged £5.00 for any failed collection and the hirer will be responsible for contacting the supplier to make alternative arrangements for return of hire wear. The hirer will also be charged £15.00 late return fee per day, per hire reservation.
d) The hirer is advised to retain the consignment note received from the carrier as evidence of collection.
3. Accidental Damage Insurance
a) The hirer agrees to a mandatory accidental damage insurance premium of £5.00, which covers accidental damage to any hire wear.
b) This insurance does not cover garments which in the supplier’s opinion have been damaged through inappropriate use.
c) The supplier reserves the right to charge the full current retail replacement value for any hire wear which is lost or stolen as this is not covered by the accidental damage insurance.
d) Hire bags are loaned at no additional cost and are therefore not covered by the accidental damage insurance. Non returned or damaged hire bags will be charged at the full current retail replacement value.
4. Security Deposit
A security deposit is not required however, at the time of reservation, the hirer’s authorisation is mandatory that in the event of damage (hire wear not covered by Accidental Damage Insurance) or non return of hire wear, the supplier is authorised to charge the full current retail replacement value of the hire wear to the hirer’s credit or debit card.
5. Cancellation & Refund Policy
a) The hirer will be required to pay the full cost for each hire reservation in the event of cancellation within 48 hours of the hire collection date.
b) Cancellations prior to 48 hours of the hire collection date will be subject to a £20.00 cancellation fee and a credit note for the remaining hire value paid. The credit note is only valid for the hire department and for a period of 12 months. For hires less than £20.00 value, the full amount of the hire will be retained.
c) In the unlikely event that faulty hire wear is supplied, the supplier will rectify the problem or may offer a refund subject to the hirer contacting the supplier within 24 hours of receiving the hire wear.
