Terms and Conditions

Please read our terms and conditions carefully as they contain important information which you need to know in order to visit and use our website and to ensure an easy, enjoyable, safe and secure shopping experience. We reserve the right to make changes to our terms and conditions and our website will be updated as soon as possible to reflect these changes. It is your responsibility to regularly check our terms and conditions to ascertain any changes.

Ownership of Rights
All rights, including copyright (text or graphical) in this website are owned by Highland House of Fraser Ltd. Any unauthorised use of this website or its contents, including copying or storing in whole or part, other than for personal non-commercial use, is an infringement of that legal right.

Information Accuracy
We make every effort to ensure that our on-line shop is as accurate and complete as possible where products are fairly described and prices quoted are correct at time of publishing. All measurements, weights, dimensions and capacities listed are approximate. Due to system errors, sometimes products or prices may be inaccurately advertised on our website and therefore, please note that orders will only be accepted if there are no errors in the description or price of goods on this website. As computer monitors can be set differently, some colours displayed may vary slightly and will not accurately reflect the colour of the product upon delivery. For example, the colour of tartans can vary significantly. Particular tartans may be woven by more than one mill thereby using differing dyes and thread counts. Similarly a mill may manufacture a tartan in various weights whereby the heavier the weight, the larger the sett (pattern). Thus, when selecting tartans the dye and cloth weight must be taken into consideration, if trying to match with another product.

Availability
All products are subject to availability and product availability may change before we have had an opportunity to update our website. We will advise you as soon as possible if the goods you have ordered are unavailable.
Order Restrictions
By placing an order for the following products you are confirming that you are over age 18; knives or bladed articles.

Order Confirmation
We will contact you via your supplied e-mail address as soon as possible to confirm receipt of your order. A further e-mail will follow advising that charges have been verified and acceptance of your order. However, we reserve the right to cancel the contract at any time up until the despatch of the product(s) ordered. In these circumstances we will contact you as soon as possible.

Delays & Substitution
Occasionally, there may be a delay in goods due to high demand or material shortages. We will contact you as soon as possible should this situation arise and keep you informed of progress. Alternatively, we may offer substitute goods of equal quality and value, however we will not substitute goods without your prior authorisation.

Taxes
All prices displayed are inclusive of V.A.T. (Value Added Tax). V.A.T. is automatically charged on qualifying goods for delivery to countries within the EU (European Union). The standard rate of V.A.T. is currently 20% but certain items are rated at 5% and 0%. For example, most items of children's clothing are subject to 0%. Goods deliveries to all other areas of the world are V.A.T. exempt and are therefore charged less V.A.T. Although we deduct V.A.T in these circumstances, deliveries may be subject to taxes being charged by the local customs authorities in the country of destination. We do not take any responsibility for any such taxes, or for any goods delayed or seized by the country of destination local customs authorities. Generally, we have found that only a small percentage of export orders are subject to local import taxes, however it may be advisable to check with your local customs authority before placing any order(s).

Cancellation
Under the Distance Selling Regulations, you have the right to cancel your order and may do so up until 7 working days after the day of receipt of your order to notify us. Notification of cancellation should be in writing; letter, fax or e-mail, referencing your order number. In the event of cancellation, it is your responsibility to return the goods to us at your expense and we suggest that proof of postage is obtained. A recovery fee will be applicable for failure to return goods. Delivery charges will not be refunded for goods that have already been mailed.
Exception to the right to cancel; goods made to your specification, pierced jewellery or CD’s/DVD’s if seal is broken, gift wrap service – all sales are final sales and may not be cancelled or returned, however, this does not affect your statutory rights.
If goods have been delivered to a third party at your request, then your right to cancel can only be exercised if you are able to return the goods you ordered to us.
Whilst the goods are in your possession, you must take reasonable care of them and return them to us in an unworn and resaleable condition. If returning goods from overseas, please mark package as “returned goods” or the goods may be subject to import tax.

Gift Service
Gift Message - content of messages requested by you to be sent by us to a third party should not contain any comments that may cause embarrassment or distress. You must also not impersonate any other person. It is your responsibility to check content of message and we retain the right to refuse to forward messages at any time and without liability to you.  Gift Wrap - all items ordered will be wrapped into as few gift packaging as possible.  If separate parcels are required, you should place separate orders and select and pay for gift wrap for each order.

Privacy & Security
We respect your privacy and any personal information that we hold will be kept secure and processed fairly and lawfully. We will not release any information to third parties, but may occasionally release information to a third party for the purpose of processing your order. The personal information we hold is only to enable us to fulfill orders, to process billing and to advise you of products or special offers that may be of interest to you. Credit card information is processed on a secure server which is compliant with all relevant regulations. We have links on this website to other websites, but Highland House of Fraser Ltd cannot accept any liability for the privacy and security policies or content of these websites. Any changes to our policy will be updated on our website immediately.

Fraud
You must not impersonate any other person or entity or use a false name. We occasionally make special purchase offers and any attempt to take advantage
of offers which contravene the terms and conditions of such offers, may be deemed fraudulent.

Limitation of Liability
Highland House of Fraser Ltd uses reasonable endeavours to ensure the validity and accuracy of any information we place on our website, but we accept no liability in contract (including negligence) for any misfortune, direct or indirect losses (economic, goodwill or reputation) or injury caused through the information published on this website. Any disputes will be settled in accordance with Scottish law.

Returns/Refund Policy
We hope you will be satisfied with your purchase, but should you wish to make a return we will be pleased to exchange or refund a product within 30 days of receipt of goods. Returned products should be unused and in a resaleable condition, including the original labeling and packaging.
Please contact us first prior to returning any goods. It is your responsibility to return the goods to us at your expense and we suggest that proof of postage is obtained. If returning goods from overseas, please mark package as “returned goods” or the goods may be subject to import tax which would be your responsibility.
You may also take the return goods to our shop in Inverness. Please bring the despatch note with you and advise the sales assistant that you made an online purchase.

Original delivery charges will only be refunded if the goods are returned as faulty or not as described.
Refunds will be made to the same credit card that was used to purchase goods. Please allow us at least 2 weeks to process your refund once goods have been received by us.

Despatch/Delivery
We aim to despatch goods within 48 hours of receipt of order.
Items that are supplied to order may take up to 4 weeks from receipt of order.
Made-to-measure items may take 4-8 weeks from receipt of order.
Please ensure any urgent delivery information is noted during checkout process in Delivery Notes box.
Orders will be despatched once all items ordered are ready. If some items are required earlier, please place separate orders.
UK V.A.T. (Value Added Tax) will be automatically deducted from qualifying goods despatched to non-EU countries, which will be clearly indicated during the checkout process.


UK £3.00: 1st Class Mail, 1-5 Working Days
UK £6.95: 2 Working Days

Europe A: 2 Working Days
Belgium, Denmark, France (including Corsica), Germany, Ireland (Republic of), Luxembourg, Monaco & Netherlands

Europe B: 2 Working Days 
Greece, Italy (including Sardinia & Sicily), Portugal (including Azores & Madeira), & Spain (including Balearic Isles).
